GUIDE TERMS OF SERVICE

    At a glance

    This is a brief summary of the key rules. It is provided for convenience; the full Terms of Service are binding.

    • Adults only. GUIDE is available only to people aged 18 or over. You may have one account, and each profile must represent a real person. Profile verification is therefore mandatory.
    • Your subscription renews automatically. GUIDE Premium renews until you cancel it. You must cancel it through your App Store or Google Play settings, rather than in the GUIDE app. Cancelling your subscription does not delete your account, and deleting your account does not cancel your subscription.
    • Refunds and the right of withdrawal. Apple and Google process purchases. As a consumer, you have 14 days to withdraw from the contract on the terms set out in section 9.
    • Complaints. Send complaints to support@guide-dating.com. We respond within 14 days.
    • No arbitration. The contract is governed by Polish law. Disputes are resolved by the ordinary courts, and your consumer rights remain unaffected.

    We have included a short summary at the beginning of each section to help you understand these Terms. The summaries do not replace the sections themselves. Please read them in full.

    1. Introduction

    By using GUIDE, you enter into a contract with us on the terms set out in these Terms of Service. Please read them carefully together with the Privacy Policy.

    These Terms of Service (the “Terms”) govern the use of the GUIDE mobile application, GUIDE accounts and the guide-dating.com website (together, “GUIDE” or the “Service”). These Terms constitute terms for the provision of services by electronic means within the meaning of Article 8 of the Polish Act of 18 July 2002 on the Provision of Services by Electronic Means.

    The service provider and the party entering into the contract with you is GUIDE PROSTA SPÓŁKA AKCYJNA (GUIDE P.S.A.), with its registered office in Warsaw at ul. Przeworska 6, 04-382 Warszawa, entered in the register of entrepreneurs of the National Court Register under KRS number 0001182860 (registration records held by the District Court for the Capital City of Warsaw in Warsaw, Commercial Division of the National Court Register), tax identification number (NIP) 1133173303, statistical identification number (REGON) 542202801 (referred to as “GUIDE”, “we” or “us”).

    The GUIDE Privacy Policy, available in the app and at guide-dating.com, explains how we process your personal data. These Terms and the Privacy Policy use the same terminology and complement each other: the Terms set out the conditions on which we provide our services, while the Privacy Policy explains how we process data in connection with those services.

    By creating an account, you confirm that you have read and accept these Terms. The contract for the provision of services by electronic means is concluded when you create an account and continues for an indefinite period. You may terminate it at any time by deleting your account (section 10). If you do not accept these Terms, do not create an account or use GUIDE.

    We make these Terms available free of charge in the app and at guide-dating.com in a format that allows you to download, save and print them. The current version number and effective date appear at the beginning of this document. Section 1b explains how these Terms may be amended.

    GUIDE is intended solely for private use. Accordingly, every GUIDE user is a consumer within the meaning of applicable law, and these Terms must be interpreted in light of mandatory consumer protection laws. Nothing in these Terms excludes or limits any rights you have under those laws.

    1a. Mandatory features

    We reserve the right to introduce mandatory features at any time, meaning features that you must use in order to access GUIDE or part of it. These include, in particular, Profile Verification, confirmation that you are an adult, App updates, Account security measures, and consents and confirmations required by law. We introduce mandatory features to improve the operation and safety of GUIDE, protect users against abuse or fulfil our legal obligations.

    We will notify you in the App when we introduce a mandatory feature. If you choose not to use it, you may lose access to certain features or to your Account; in that case, you may delete your Account at any time in accordance with section 10. If a mandatory feature materially and adversely affects your access to or use of the service, the rules in section 1b apply, including your right to terminate the contract at no additional cost.

    1b. Changes to these Terms

    These Terms may change. We may amend them for valid reasons, particularly where: the law or its interpretation changes, or a judgment or decision requires an amendment; we introduce, change or withdraw GUIDE features, including mandatory features; technical conditions or the terms of our suppliers or the Stores change; an amendment is necessary for security or abuse prevention; our legal or organisational circumstances change; or we need to correct errors, clarify provisions or reorganise the text.

    We will notify you of changes to these Terms in the App or by email at least 14 days before they take effect, specifying the effective date and making the revised Terms available. The current version is always available in the App and at guide-dating.com; we encourage you to check it from time to time. Changes that are solely beneficial to you, are technical or editorial, or are required by law may take effect on shorter notice where justified.

    If you do not accept the changes, you may terminate the contract free of charge by deleting your Account before the changes take effect. Continuing to use GUIDE after that date constitutes acceptance of the revised Terms. Notwithstanding the above, material changes to the liability provisions (section 13) or dispute resolution provisions (section 15), changes that adversely affect paid features you use, and any other material changes for which the law requires your express acceptance are subject to that acceptance. We will request it in the App and, until you give it, will continue to apply the previous provisions to the extent possible.

    Changes to these Terms do not affect purchases made before the changes take effect in respect of the current billing period, unless the change benefits you. We reserve the right to change the features available under the free plan and paid plans in accordance with this section and section 9. Previous versions of these Terms are available on request.

    We continue to develop GUIDE. We may introduce, change or withdraw features where justified, particularly by product development, security considerations, changes in the law or changes to the terms offered by our suppliers. We make such changes at no additional cost to you. We will give you advance notice of changes that materially and adversely affect your access to or use of the service. In that case, you may terminate the contract at no additional cost within 30 days of receiving the notice or of the change being made, whichever is later.

    1c. Technical requirements

    To use GUIDE, you need an iOS or Android smartphone, an App Store or Google Play account, and internet access.

    To use GUIDE, you need:

    • a mobile device running a version of iOS or Android supported by the current version of the App; we state the current minimum operating system versions in the App Store and Google Play;
    • an active App Store or Google Play account to download and update the App and make purchases;
    • internet access; your network operator may charge for data usage;
    • the current version of the App; older versions may not work properly or may no longer be supported;
    • to use guide-dating.com, a current version of a mainstream web browser with JavaScript enabled.

    Some features require you to grant the App permissions on your device, particularly access to the camera (profile photos and Profile Verification), microphone (voice messages and speech-to-text) and notifications. You may change these permissions in your device settings at any time, although a feature may be unavailable without the relevant permission.

    The App stores data on your device that it needs to operate, such as login session data, settings, cached data and a notification token. This data is used solely to operate GUIDE and is deleted when you log out or uninstall the App. Further details are set out in the Privacy Policy.

    Using services provided by electronic means involves common internet risks, such as malware, phishing, attempts to steal login credentials and unauthorised account access. We recommend keeping your software up to date, securing your device (for example, with a screen lock) and treating messages requesting login or payment details with caution. GUIDE never asks for your Store account password or payment card details.

    2. Who may use GUIDE and your obligations

    2a. Eligibility

    By creating an Account and using GUIDE, you represent and warrant that:

    • you are at least 18 years old;
    • you are an individual acting on your own behalf and use GUIDE solely for private purposes, rather than professional, profit-making or commercial purposes;
    • you have full legal capacity and can enter into a binding contract with us;
    • you are creating an Account for yourself to meet a partner, rather than on behalf of or for the benefit of another person;
    • you do not have another active GUIDE Account;
    • GUIDE has not previously deleted or blocked your Account for breaching these Terms, unless we have expressly agreed to let you register again;
    • you have not been convicted by a final judgment of an offence involving violence or the threat of violence, an offence against sexual freedom and decency, or persistent harassment;
    • you are not prohibited by law from using GUIDE.

    If you cease to meet any of these conditions, your right to use GUIDE ends, and we may restrict, suspend or delete your Account in accordance with section 10.

    GUIDE is intended for adults only. During registration, you cannot enter a date of birth indicating that you are under 18, and every user must confirm that they are an adult. If we reasonably suspect that an Account belongs to a minor, we may suspend it and request proportionate evidence of age. We delete Accounts belonging to minors and may block them from registering again. Further information is available in the Privacy Policy.

    To protect the GUIDE community, we require Profile Verification before enabling matchmaking. This confirms that the Profile represents the real person shown in the photos. You may choose manual verification (a member of the GUIDE team reviews the materials specified in the App, without automated processing of biometric data) or automated verification (you take a selfie, and our provider Didit checks that a live person is present and compares the selfie with your main profile photo; this option requires your separate, explicit consent to the processing of biometric data, which you may withdraw at any time). We may ask you to verify your Profile again, particularly after you change your main profile photo, following a report or where we have reasonable concerns. Failed verification or refusal to undergo verification may result in restricted access to matchmaking. Verification confirms only that a Profile represents a real person; it is not an identity check or a criminal record check (section 5).

    2b. Your commitments

    By using GUIDE, you agree to:

    • comply with these Terms and check this page regularly to stay informed of any changes;
    • comply with applicable laws, including data protection laws, intellectual property laws, anti-spam laws and regulatory requirements;
    • provide true, current information about yourself, including your real first name, age and recent photos, and update it when it changes;
    • use the current version of the App;
    • treat other users respectfully and courteously, both on GUIDE and elsewhere if you met through GUIDE;
    • be courteous to members of the GUIDE team;
    • read and follow the community guidelines (section 4a) and safety tips (section 5c);
    • protect your Account and login details, keep them private and notify us promptly if you suspect that someone has gained unauthorised access to your Account.

    2c. Prohibited conduct

    You agree not to:

    • misrepresent your identity, age, current or previous employment, qualifications or affiliation with a person or organisation;
    • create more than one Account or create a new Account after we have suspended or deleted a previous one, unless we have expressly agreed to it;
    • use another person’s Account or share your Account with others;
    • use GUIDE for profit-making, commercial, promotional or recruitment purposes, including advertising products, services, social media accounts, paid content or other services;
    • ask other users for money, card details, login details, documents or other benefits, or use GUIDE for fraud, scams, pyramid schemes, money laundering or other unlawful activities;
    • harass, intimidate, stalk, insult, humiliate, blackmail or otherwise harm anyone, or encourage such conduct;
    • send unsolicited sexual content or exert sexual pressure on anyone;
    • publish or send Prohibited Content (section 2d);
    • share other users’ content, photos, messages or data outside GUIDE, including screenshots of conversations or Profiles, without their consent;
    • solicit other users’ personal data for commercial or unlawful purposes;
    • use GUIDE in connection with political campaigning, canvassing or attempts to influence an election;
    • attempt to manipulate the AI Assistant, particularly by inducing it to disclose information about other users, circumvent GUIDE’s rules or generate prohibited content, or use the AI Assistant for purposes other than those for which it is intended;
    • unfairly influence the matchmaking process, including by providing false preferences or answers to obtain Suggestions that do not reflect your actual intentions;
    • use GUIDE in a way that harms the Service, its infrastructure or other users, including by disrupting the App, servers or networks;
    • use robots, bots, scripts, scrapers, plug-ins, automated tools or other methods to access, retrieve, index or copy any part of GUIDE or its Content;
    • use or create applications, services or tools, including AI-based tools, that interact with GUIDE, its Content or its users without our prior written consent;
    • copy, modify, translate, decompile, reverse engineer, reconstruct the source code of, or otherwise interfere with the App or any part of GUIDE, except where expressly permitted by law;
    • access or attempt to access GUIDE’s application programming interfaces (APIs), systems or data without our consent, or test or circumvent GUIDE’s security measures;
    • upload viruses, malicious code or other materials that could damage GUIDE or other people’s devices;
    • forge headers, identifiers or other information to conceal the source of transmitted data;
    • use the GUIDE name, our logo, trademarks or other branding in a way that suggests we have authorised your activities;
    • state or imply that GUIDE endorses statements made by other users;
    • disclose confidential or proprietary information that you are not entitled to disclose;
    • submit reports about other users that are false, misleading or manifestly unfounded, or misuse the reporting and blocking system;
    • encourage anyone else to engage in any of the conduct described in this section.

    Engaging in any of the conduct listed above constitutes a material breach of these Terms and may result in the restriction, suspension or deletion of your Account and the termination of the licence referred to in section 7.

    2d. Prohibited Content

    You must not publish, send or share unlawful content on GUIDE, or content that:

    • could reasonably be considered offensive, harassing, intimidating, embarrassing, degrading or intended to cause another person distress;
    • is obscene or pornographic, depicts nudity or violence, or otherwise violates human dignity;
    • exploits, insults, threatens or discriminates against others, or promotes racism, sexism, homophobia, transphobia, hatred or bigotry;
    • is unlawful or encourages unlawful activity, including terrorism, human trafficking, money laundering, child exploitation or incitement to violence or hatred;
    • encourages conduct that could harm a user or another person, including self-harm, eating disorders, dangerous challenges or extremism, or spreads harmful disinformation;
    • is fraudulent, defamatory or false;
    • is commercial or intended to generate profit, including advertisements, job offers, investments, fundraising, competitions or links to paid websites or accounts on other services;
    • constitutes spam or unsolicited communications, or is used to distribute them;
    • contains malware, viruses, corrupted files or code intended to damage, take control of or disrupt systems, devices or data;
    • infringes third-party rights, including copyright, rights to a person’s likeness, privacy rights or trade secrets;
    • includes another person’s likeness without their consent;
    • depicts a minor who is not accompanied by a parent or legal guardian, is not fully clothed or is portrayed in a sexualised manner;
    • is inconsistent with GUIDE’s intended purpose, including content that clearly does not relate to you or your life;
    • harms GUIDE’s reputation or encourages misuse of GUIDE.

    Publishing or sharing the content described above (“Prohibited Content”) may result in its immediate removal and the restriction, suspension or deletion of your Account, in accordance with section 4.

    3. Content

    It is important that you understand your rights and responsibilities concerning content on GUIDE, including content you submit or publish. We expressly prohibit the publication of inappropriate content.

    When using GUIDE, you may have access to: (i) content you publish, submit or share through GUIDE, including content suggested or prepared by GUIDE, for example by the AI Assistant (“Your Content”); (ii) content published or submitted by other users when they use GUIDE (“User Content”); and (iii) content provided by GUIDE on or through the Service (“Our Content”).

    GUIDE uses, and may offer you, technology based on artificial intelligence or machine learning (“AI Technologies”) as part of the Service, particularly the AI Assistant, profile summaries, explanations of Suggestions and contextual notes. You are solely responsible for any content you create, submit or share that has been generated using these AI Technologies, such as an “About me” summary you have approved. In these Terms, “Content” includes all text, images and photos, video, audio (including voice messages and recordings submitted for speech-to-text conversion), mood boards and other materials on GUIDE. It also includes all information in user Profiles and private messages, answers given to the AI Assistant, and any content you create, submit or share that has been generated using AI Technologies.

    3a. Your Content

    You are responsible for Your Content. Do not publish content that you do not want others to see, that breaches these Terms or that could expose you or us to legal liability.

    You are solely responsible for Your Content and therefore agree to indemnify and hold us harmless against any claims relating to Your Content.

    You represent and warrant that the information you provide to us or another user, including any information provided through external sources where applicable, is accurate, and that you will update your account information as necessary to keep it accurate. The content on your personal profile must relate to the intended purpose of our Service. You must not publish Prohibited Content (section 2d), and Your Content must also comply with the GUIDE community guidelines (section 4a).

    You must not provide private contact details, banking details or details used for peer-to-peer payments, whether they belong to you or someone else (for example, full names, residential addresses or postcodes, telephone numbers, email addresses, URLs, credit or debit card details, peer-to-peer payment usernames or other banking details). If you choose to share any personal data about yourself with other users, you do so at your own risk. We strongly encourage you to exercise caution when disclosing personal data online.

    Your personal profile will be visible to other users, so make sure you are comfortable sharing Your Content before publishing it. You acknowledge that other users may view Your Content and, regardless of these Terms, may share it with third parties. By publishing Your Content, you represent and warrant that you hold all necessary rights and licences to it and automatically grant GUIDE a licence to use it in accordance with section 8 below.

    We may provide features and tools to support self-expression through Your Content and User Content, and we continually develop new technology to improve our Service. Some features and tools allow you to create or enhance content based on Your Content, including through AI Technologies. That content remains Your Content, and you are responsible for its accuracy, its use on our Service, and any decisions, acts or omissions based on it. Choose and share Your Content carefully.

    You understand and acknowledge that GUIDE may analyse, access, store and use Your Content, including messages and other communications, to monitor, develop, personalise and improve our Service, including through automated technologies, in accordance with applicable law.

    You acknowledge that GUIDE may monitor and review Your Content, and that we may remove, delete, edit or restrict any of Your Content, or block or prevent access to it, at our discretion. If Your Content is prohibited under the laws of any country where our Service is available, we may remove it even if it is lawful in your location. You also acknowledge that we are not required to display or review Your Content.

    3b. User Content

    You have access to User Content, but it does not belong to you. You must not copy it or use it for purposes other than those allowed by these Terms.

    Other users also share content on the Service. User Content belongs to the users who publish it, is stored on our servers and is displayed in accordance with these Terms only to users to whom that person has been presented as a Suggestion and users with whom that person has a Match.

    Always exercise caution when viewing User Content and assess its accuracy independently. Other users may use tools to create or enhance content based on User Content they have provided, including through AI Technologies. User Content may contain information that is biased, inaccurate, harmful, offensive or misleading. Other users are responsible for their User Content and any decisions, acts or omissions based on it. GUIDE expressly disclaims any liability for such User Content.

    You have no rights in User Content and, unless GUIDE has expressly agreed otherwise, may use it only for the Service’s intended purpose of meeting and connecting with other people. You must not copy or record User Content, share it outside the Service, or use it for profit, spam, harassment or criminal threats. We reserve the right to delete your account if you misuse User Content. The restrictions in section 2 concerning Prohibited Content apply to your use of User Content and other content. The Privacy Policy explains how we select and present Suggestions to you.

    3c. Our Content

    GUIDE owns or licenses all other content on our Service.

    As between you and GUIDE, all other text, content, graphics, user interfaces, trademarks, logos, sounds, works, images, photos and intellectual property on our Service are owned, controlled or licensed by us and are protected by copyright, trademark or other intellectual property rights. All rights, title and interest in Our Content remain with us. We grant you a limited licence to access and use Our Content in accordance with section 7 below and reserve all other rights.

    3d. AI Content

    AI Content, such as the “About me” summary, explanations of Suggestions, contextual notes and conversation summaries, is generated automatically from information provided by you and, where relevant, the other user. It is intended to assist and explain, is written in natural, non-judgemental language, and may contain errors or oversimplifications.

    You may review, approve, edit and request the regeneration of AI Content about you to the extent these options are available in the App. AI Assistant notes relating to a particular pair of users are visible only to those two users. AI Content that you use as Your Content, such as an approved summary in your Profile, is subject to the same rules as Your Content.

    4. Community guidelines, reporting and moderation

    4a. GUIDE community guidelines

    We want GUIDE to be a welcoming, safe and inclusive place where everyone can be themselves while meeting others. These community guidelines set out what we expect of everyone, both in and outside the app. Please read them carefully: breaking them has real consequences, ranging from a warning to an account ban.

    GUIDE’s rules:

    • Respect boundaries. Everyone has different comfort levels. We therefore do not allow nudity, sexual content, descriptions of sexual desires or requests for sex in Profiles. In private conversations, such content is acceptable only if both people are comfortable with it. Consent matters.
    • Share carefully and use good judgement. Do not include personal data or contact details in your Profile, such as your phone number, email address or social media handles. Sharing your bank account number or email password is always a bad idea. Do not ask others for their private information either. Stay alert: if someone asks you for money or encourages you to invest, it is most likely a scam.
    • Keep violence out of GUIDE. We encourage positive interactions and do not tolerate content depicting violence, including gore, death, images or descriptions of violence against people or animals, the use of weapons, or anything that encourages or glorifies self-harm. If we believe there is a risk of imminent harm, we may take steps to help, such as contacting you directly and providing information about crisis support.
    • Build personal connections, not business relationships. Do not advertise, promote, share social media accounts to gain followers, sell, fundraise or campaign. GUIDE is also not a place for any form of sex work, escort services or compensated relationships. This means you must not use GUIDE to look for a sugar daddy or a similar arrangement.
    • Be yourself. People want to meet the real you, not a fictional character. Do not create a fake account or pretend to be someone you are not, even as a joke.
    • Communicate respectfully. Talking to new people can be difficult, especially when they come from very different backgrounds. Respect makes a real difference. If a conversation unexpectedly takes a bad turn and you feel yourself getting angry, pause and think before responding. Harassment, threats, intimidation, doxing, sextortion, blackmail and any conduct intended to cause harm are prohibited. There is no place for hate on GUIDE. We will never tolerate racism, bigotry, hatred or violence based on who someone is, how they identify or how they look. This includes race, ethnicity, nationality, immigration status, caste, religion, gender identity, sexual orientation, disability, body type and health status. If someone does not meet your personal criteria or you are not attracted to them, decline the Suggestion or end the Match and move on. Do not report them unless you believe they have broken our rules.
    • Act with kindness and do no harm. We take any action or behaviour that suggests, intends or causes harm to another user very seriously, whether it happens in or outside the app, physically or digitally. This also includes encouraging or inciting harm. If someone on GUIDE has harmed you, first take care of yourself, then give yourself time to decide what you need to recover, whether that means holding the person accountable, talking about what happened, seeking support or all of these. If you want to report the harm to us, please contact us. We are here for you.
    • Adults only. You must be at least 18 to use GUIDE. We also do not allow photos of minors who are unaccompanied by an adult or are not fully clothed. This includes your own childhood photos, however cute you were.
    • Follow the law. Illegal content and activities are always prohibited. You must not use GUIDE to buy or sell drugs or counterfeit goods, or ask for help breaking the law. We do not tolerate any use of GUIDE to promote or take part in harm to minors or human trafficking.
    • One person, one account. Each account may have only one owner. For operational and privacy reasons, we do not allow several people to share an account; everyone must have their own. No one may have more than one account at a time.
    • This is your space: share your own content. Do not publish other people’s photos or private messages without their consent. Do not publish material protected by someone else’s copyright or trademark.
    • Use GUIDE responsibly. Do not abuse GUIDE. Do not use it to spread false or misleading information. Do not send harmful links or unsolicited content. Do not create accounts in bulk. Do not use GUIDE to manipulate or deceive people, or to induce them to send you money or anything else. You may talk to people close to you about the people you meet, but do not publish other people’s information. Do not submit false, misleading or malicious reports. Do not use external apps or other technology to unlock features or cheat the system; this includes attempts to manipulate the AI Assistant. Do not harass, threaten or otherwise break these rules when communicating directly with the GUIDE team either.
    • Stay active. If you do not use GUIDE for 90 days, we pause matchmaking. If you do not log in to your account for 12 months, we will consider it unused and may delete it for inactivity. If you want to remain visible in the app, check in from time to time.

    Reporting

    As a member of the GUIDE community, speak up. If someone harms you or breaks our community guidelines, report it. We always treat your report as confidential. Reporting helps us stop harmful behaviour and protect others.

    Consequences

    We take our community guidelines and their impact on our community seriously. We will do everything within our power to enforce them. We use a warning system, but we will take appropriate action if violations are repeated or serious.

    We reserve the right to investigate and/or delete your account without refunding purchases if we determine that you are misusing the Service or behaving in a way that GUIDE considers inappropriate, unlawful or in breach of the community guidelines or these Terms. This includes conduct or communications outside the Service involving people you met through it.

    4b. Reporting and blocking

    If another user’s conduct or content breaches these Terms or causes you concern, report it directly in the App using the “Report” option in the user’s Profile or the conversation, or email support@guide-dating.com. You may also block a user. A blocked user will not be able to contact you and will not be suggested to you again.

    Your report should include enough information for us to identify the user or content, together with a description of the problem. We review every report with due care and without undue delay. We will inform you of the action taken to the extent permitted by law and by the need to protect other people’s privacy and safety. We may not disclose the details of a decision concerning another user.

    Reports that are manifestly unfounded, made in bad faith or used to harass someone breach these Terms. Repeated reports of this kind may result in restrictions on your ability to submit reports or in the suspension or deletion of your Account.

    4c. Moderation and consequences of breaches

    We use a combination of automated tools and human assessment to enforce these Terms. Automated systems may flag Accounts, content or interactions for safety review. An automated flag alone does not lead to an Account being blocked, suspended or permanently restricted; an authorised member of the GUIDE team makes those decisions.

    Depending on the seriousness and frequency of the breach, we may:

    • issue a warning or ask you to change content;
    • remove content or limit its visibility;
    • temporarily restrict access to certain features, such as sending messages or receiving Suggestions;
    • suspend your Account while we investigate;
    • delete your Account and prevent you from registering again in cases of serious or repeated breaches, particularly fraud, harassment, violence, content that sexualises minors, terrorist content, impersonation or use of GUIDE by a minor.

    We will inform you when we restrict, suspend or remove content or your Account, giving the reason and explaining how to appeal, unless doing so would be unlawful, hinder an investigation or put others at risk. We may remove manifestly unlawful content immediately.

    If you believe our decision was wrong, you may appeal by emailing support@guide-dating.com within 6 months of receiving notice of the decision. Your appeal will be reviewed by a member of the GUIDE team who did not make the original decision. We respond without undue delay. You may express your point of view and contest the decision. Your right to appeal does not affect your statutory rights, including the right to submit a complaint (section 11).

    Where provided for by law, we may share information about breaches with the competent authorities, including law enforcement authorities, as described in the Privacy Policy. We retain information about reports, moderation and blocks for the period specified in the Privacy Policy, including after an Account has been deleted, to prevent further abuse and attempts to circumvent restrictions.

    5. Safety

    Profile Verification confirms only that a Profile represents a real person. We do not check users’ criminal records, backgrounds or the accuracy of what they say about themselves. You are responsible for your interactions with others. Exercise caution, especially when meeting someone for the first time.

    5a. What we do not check

    Apart from the Profile Verification described in section 2a, we do not verify users’ identities, criminal records, backgrounds, marital status, finances, health or the accuracy of the information they provide about themselves. We make no representations about users’ behaviour, intentions, honesty or trustworthiness.

    We reserve the right, but are not obliged, to carry out additional checks if we consider them necessary for safety reasons or if required by law. For this purpose, we may use information you have provided and publicly available information, as described in the Privacy Policy.

    5b. Your interactions with other users

    GUIDE helps you meet people but is not a party to the relationships you form through it. You are solely responsible for your interactions with other users, both on GUIDE and elsewhere. To the extent permitted by law, we are not responsible for users’ conduct. Always use your own judgement and take reasonable precautions.

    Communications you receive through GUIDE, including Suggestions, explanations and AI Assistant notes, do not confirm that someone is safe, honest or right for you. A high compatibility score is no substitute for caution.

    5c. Safety tips

    Please read and follow these safety tips:

    • Take your time before sharing personal details. Do not share your surname, address, workplace, phone number or financial details until you have built trust. Keep your conversations on GUIDE for as long as you wish.
    • Never send money. A request for money, card details, an investment, cryptocurrency or “emergency help” is almost always a scam, even if the person seems sincere. Report them.
    • Be wary of pressure to move quickly. People who quickly declare their feelings, insist on moving the conversation off GUIDE, avoid video calls or refuse to meet may not be who they claim to be.
    • Meet in public the first time. Choose a public place at a time when plenty of people will be around. Do not agree to be picked up from home or to meet in a private home.
    • Tell someone. Let someone close to you know who you are meeting, where and when, and stay in touch with them.
    • Arrange your own transport. Make sure you can get home independently, and do not leave your drink unattended.
    • Trust your instincts. If something worries you, you may end the conversation or meeting at any time without having to explain yourself.
    • Report concerns. Report any concerning behaviour to us (section 4b). If someone’s health or life is in danger, call the emergency number 112.

    6. Privacy

    Your privacy matters to us. Our Privacy Policy explains how we process your data. Please read it.

    The GUIDE Privacy Policy explains what personal data we process, for what purposes and on what legal bases, who we disclose it to, how long we retain it, and what rights you have. GUIDE P.S.A. is the controller of your personal data.

    GUIDE gives you access to other users’ personal data. You may use it only to make personal connections on GUIDE. You must not collect it, process it for other purposes, share it with third parties or publish it.

    7. The licence we grant you

    We grant you a personal, limited licence to use GUIDE in accordance with these Terms.

    For as long as you comply with these Terms, we grant you a personal, non-exclusive, non-transferable, non-assignable, revocable and non-sublicensable licence to access and use GUIDE solely for its intended purpose and in a manner permitted by these Terms and applicable law.

    The licence allows you to download and install the App on a device you are entitled to use and to use it for your own personal purposes. Downloading the App from a Store is also subject to that Store’s terms, which you accept with its operator.

    The licence ends when your Account is deleted, the contract is terminated or you materially breach these Terms. All rights not expressly granted under these Terms remain with GUIDE and our licensors.

    8. Rights you grant to GUIDE

    Your Content remains yours. You grant us a licence only to the extent needed to provide the service to you, including processing Content using AI.

    You retain all rights to Your Content. However, we need your permission to use it so that GUIDE can operate, host your photos, show your Profile to compatible users, analyse your answers and create summaries.

    When you submit Content, you grant GUIDE a non-exclusive, royalty-free, worldwide licence to use Your Content to the extent necessary to provide, secure and maintain GUIDE and fulfil legal obligations. The licence covers the following types of use: recording and reproducing it digitally; storing it in computer memory and in the cloud; displaying it and making it available to other users as described in these Terms; making technical adaptations, such as resizing, cropping, compression and speech-to-text conversion; analysing and processing it, including through artificial intelligence systems, to create and update your Compatibility Profile, assess and explain compatibility, and create AI Content; and creating summaries and other adaptations based on it for the operation of GUIDE.

    The licence includes the right to grant sublicences to providers whose services we use to deliver GUIDE, particularly hosting and infrastructure providers and the AI feature provider, solely to the extent necessary for them to perform services on our behalf. The Privacy Policy lists these providers and explains how they operate.

    The licence lasts for as long as Your Content remains on GUIDE. It ends when the Content or your Account is deleted, subject to the following exceptions: (i) messages sent to other users may remain with their recipients for the period specified in the Privacy Policy, labelled “Deleted account”; (ii) deleted data may remain in secure backups for up to 7 days; and (iii) we may retain limited information where required or permitted by law, as described in the Privacy Policy.

    To the extent that Your Content qualifies for copyright protection, you agree not to assert your moral rights against GUIDE to the extent necessary for us to use the Content in accordance with these Terms. In particular, you agree to the Content being displayed without attribution and to the technical changes described above.

    You represent that you are entitled to grant this licence and that Your Content does not infringe third-party rights. If Your Content includes another person’s likeness, you represent that the person has consented to its use on GUIDE.

    If you provide feedback, suggestions or ideas about GUIDE, we may use them to develop GUIDE without restriction or payment. You are not required to provide them, and doing so does not create any obligation on our part.

    You agree that we may access, retain and disclose Your Content where necessary to: comply with a legal obligation or respond to a lawful request from a court, supervisory authority or law enforcement authority; enforce these Terms; deal with a report or complaint; protect the rights, safety or property of GUIDE, users or others; detect and prevent fraud, abuse or security threats; or establish, exercise or defend legal claims, as described in the Privacy Policy.

    9. Purchases and automatic Subscription renewal

    You may purchase products and services from GUIDE. If you purchase a Subscription, it will renew automatically and you will continue to be charged until you cancel it.

    GUIDE may offer products and services for purchase through the App Store, Google Play and other external services authorised by GUIDE (each an “External Service”, and a purchase made through one an “External Service Purchase”). All purchases on GUIDE are External Service Purchases. GUIDE does not collect payments directly and does not receive or store your full payment card details. If you purchase a Subscription, it will renew automatically until you cancel it in accordance with the terms presented at the time of purchase and explained below. If you cancel your Subscription, you may continue to use it until the end of the Subscription period, when it will expire.

    Because you can use our Service without a Subscription, cancelling your Subscription does not remove your Profile from the Service. If you want to delete your Account entirely, you must follow section 10.

    Our prices are determined by various factors. We may offer promotional prices that vary by region, Subscription duration, package size, previous purchases, Account activity and other factors. We also regularly test new features and payment options. If you do not cancel your Subscription in time, it will renew automatically at the full price stated at the time of purchase, and you authorise the External Service to charge those amounts to your chosen payment method. To the extent permitted by law, we may, including without prior notice, limit the available quantity of or discontinue any products, features, services or other offerings; impose conditions on the use of coupons, discounts, special offers or other promotions; prohibit a user from completing a transaction; or refuse to provide a user with any product, service or other offering. We display the current features included in the Subscription and Match Packages, the available billing periods and the prices in the App before you make a purchase.

    9a. External Service Purchases and Subscriptions

    External Service Purchases, including Subscriptions, are processed by the External Service and can be managed through your External Service Account. Subscriptions renew automatically until cancelled.

    When making a purchase through the Service, you pay through an External Service using your Apple ID or Google Play account (your “External Service Account”). Your External Service Account is then charged for the purchase in accordance with the terms presented at the time of purchase and the general terms governing that account. Depending on where you live, External Services may add taxes, which may change over time.

    If your External Service Purchase includes an automatically renewing Subscription, your External Service Account will be charged periodically until you cancel it. After the initial Subscription period and each subsequent period, the Subscription will renew automatically at the price and for the duration stated at the time of purchase. If you used a promotion or trial period, the price for subsequent Subscription periods may increase after the initial period in accordance with the offer terms.

    Cancelling your Subscription: If you do not want your Subscription to renew automatically, or you want to change or cancel it, you must log in to your External Service Account and follow the instructions for managing or cancelling your Subscription, even if you have deleted your Account on our Service or removed the App from your device. For example, if you purchased a Subscription through Apple ID, Apple handles cancellation, not GUIDE. To cancel an Apple ID purchase, go to your device’s Settings > [your name] > Subscriptions and follow the cancellation instructions. You may also contact Apple Support for help.

    Similarly, if you purchased a Subscription through Google Play, Google handles cancellation. To cancel a Google Play purchase, open the Google Play app on your mobile device and go to Payments & subscriptions > Subscriptions. You may also contact Google Play for help. If you cancel your Subscription, you may continue to use the cancelled service until the end of the Subscription period. The Subscription will not renew after that period ends.

    If you initiate a chargeback or otherwise reverse a payment made through your External Service Account, GUIDE may, at its discretion, delete your Account immediately on the basis that you have decided you no longer want a GUIDE Subscription. If the chargeback or payment reversal is overturned, please contact customer support. GUIDE will retain all amounts charged to your External Service Account until you cancel the Subscription through that account. Consumers have the right to request a refund. Further information is provided in section 9c below.

    9b. Match Packages

    Match Packages are non-refundable and subject to specific conditions.

    From time to time, you may be able to purchase a limited, personal, non-transferable, non-sublicensable and revocable licence to access and use special features with limited uses, particularly Match Packages, which provide a specified number of additional Suggestions beyond those included in your plan (“Match Packages”). You may purchase Match Packages only from us and our authorised partners through our Service. We may limit the number of Match Packages you can purchase within a given period.

    Match Packages are held under a limited licence subject to these Terms. Unless prohibited by applicable law, these Terms do not transfer any title or ownership rights in Match Packages to you. Nothing in these Terms may be interpreted as providing for the sale of any rights in Match Packages.

    The number of unused Suggestions from a Package in your Account does not represent any real or stored monetary value; it only defines the scope of your licence. Unused Suggestions do not incur charges, but under these Terms your Match Package licence expires when GUIDE stops offering its Service or your Account is closed or deleted, whichever happens first. We present Suggestions from a Package as users who meet your preferences become available.

    GUIDE reserves the right, at its discretion, to charge for access to or use of Match Packages and may offer additional Suggestions for a fee or free of charge. GUIDE may manage, regulate, control, modify or remove Match Packages at any time, including taking actions that may affect the perceived value or purchase price of a Match Package. GUIDE will not be liable to you or any third party for exercising these rights. Match Packages may not be transferred: you must not sell, exchange or otherwise transfer them to any other person or entity.

    ALL PURCHASES OF MATCH PACKAGES THROUGH OUR SERVICE ARE FINAL AND NON-REFUNDABLE, SUBJECT TO YOUR STATUTORY RIGHTS DESCRIBED IN SECTION 9c. YOU ACKNOWLEDGE THAT GUIDE IS NOT REQUIRED TO PROVIDE A REFUND FOR ANY REASON AND THAT YOU WILL NOT RECEIVE MONEY OR OTHER COMPENSATION FOR UNUSED PACKAGE SUGGESTIONS LOST WHEN YOUR ACCOUNT IS DELETED, WHETHER VOLUNTARILY OR OTHERWISE.

    9c. Refunds

    As a general rule, purchases are non-refundable. Special refund provisions apply to consumers in the European Union, the European Economic Area, the United Kingdom and Switzerland.

    Generally, all purchases are final and non-refundable, and GUIDE does not provide refunds or allocate Suggestions for partially used periods, unless the law applicable where you live provides otherwise.

    For subscribers living in the European Union, the European Economic Area, the United Kingdom and Switzerland: You have a legal right to withdraw from the contract and receive a full refund within 14 days of the start of your Subscription. The 14-day period begins when your Subscription is activated. To meet the deadline, you only need to send your notice of withdrawal before the period expires. You may use the form in Annex 1, but this is not mandatory.

    For purchasers of Match Packages: By purchasing a Match Package, you agree that we may begin presenting Suggestions from the Package immediately, before the 14-day withdrawal period expires, and acknowledge that you lose the right of withdrawal once all Suggestions included in the Package have been presented. If you withdraw before the service has been fully performed, we will refund the proportion of the price corresponding to Suggestions that have not yet been presented.

    If any of the above provisions apply to you and you subscribed through Apple ID, Apple handles your refund request, not GUIDE. To request a refund, contact the External Service directly. For example, on an Apple device, go to Settings > [your name] > Media & Purchases > View Account > Purchase History. Find the transaction and select “Report a Problem”. You can also request a refund at reportaproblem.apple.com or through Apple Support. If you purchased through Google Play, you can submit a refund request at play.google.com under Orders and purchase history. For other transactions, or if you have difficulty obtaining a refund, contact customer support. Send or deliver a signed and dated letter stating that you, as the purchaser, are withdrawing from the contract, or using words to that effect. Include the order number shown in the Store’s purchase confirmation email and the email address associated with your Account. Send the letter to support@guide-dating.com or GUIDE P.S.A., ul. Przeworska 6, 04-382 Warszawa.

    10. Account deletion and termination

    You may delete your Account at any time. We may delete it if you breach these Terms or if required by law, and will always give a reason unless the law provides otherwise. Remember to cancel your Subscription in the Store first.

    10a. Deleting your Account

    You may terminate the contract at any time by deleting your Account directly in the App: Profile > three-dot icon > Settings > Delete account. If you cannot access the App, follow the instructions at guide-dating.com/delete-account or email support@guide-dating.com.

    Account deletion is irreversible. Once your Account is deleted, we delete or anonymise your data in accordance with the rules and time limits set out in the Privacy Policy. Messages you sent to other users may remain in their inboxes for the period specified in the Privacy Policy, labelled “Deleted account”.

    Deleting your Account does not cancel your Subscription. If you have an active Subscription, cancel it in the Store before deleting your Account (section 9a). You are not entitled to a refund for the Subscription period remaining after you delete your Account, unless the law or the Store’s rules provide otherwise.

    10b. Restriction, suspension or deletion of your Account by GUIDE

    We may terminate the contract and delete your Account on 14 days’ notice for valid reasons, particularly if we stop providing GUIDE or part of it, or if required by changes in the law, decisions of competent authorities or a material change in the terms offered by our suppliers. We will give notice in the App or by email.

    We may restrict or suspend access to your Account, or terminate the contract with immediate effect and delete your Account, if:

    • you materially or repeatedly breach these Terms, particularly sections 2, 3 or 4;
    • you do not meet the eligibility conditions in section 2a, including where we reasonably suspect that you are a minor;
    • you have not passed Profile Verification, refuse to undergo it, or there are reasonable grounds to suspect that the Profile does not represent a real person;
    • your actions threaten the safety or security of other users, GUIDE or third parties, or expose us to legal liability;
    • this is required by law, a court judgment or a decision of a competent authority;
    • the Account was created to circumvent a previous restriction or deletion.

    We will notify you by email or in the App if we restrict, suspend or delete your Account, stating the reason and how to appeal, in accordance with section 4c. You may appeal the decision under that section. We may prevent a person whose Account we deleted for breaching these Terms from registering again.

    If we delete your Account with immediate effect for any of the reasons listed above, you are not entitled to a refund for an unused Subscription period or unused Package Suggestions, unless mandatory law provides otherwise. If we terminate the contract on notice for valid reasons, we will refund the proportion of the price corresponding to the unused Subscription period or unused Suggestions.

    When the contract ends, regardless of the reason, provisions of these Terms that are intended by their nature to survive termination remain in force. These include, in particular, provisions concerning Content, liability, complaints, governing law and retained information.

    11. Complaints

    If GUIDE does not perform in accordance with the contract, submit a complaint to support@guide-dating.com. We respond within 14 days. You may also use out-of-court dispute resolution procedures.

    You may submit a complaint about GUIDE, including the operation of the App, a Subscription, a Match Package or customer support, by emailing support@guide-dating.com or writing to our registered office. To help us deal with it promptly, provide the email address associated with your Account or other information that allows us to identify it, a description of the problem and when it occurred, and the outcome you are seeking. If the complaint concerns a purchase, also provide the transaction ID or purchase confirmation from the Store.

    We respond to complaints within 14 days of receipt, using the email address from which the complaint was sent or another durable medium you specify. If we do not respond within that period, the complaint is deemed to have been accepted.

    We are responsible for ensuring that the digital service conforms to the contract in accordance with the Polish Consumer Rights Act of 30 May 2014. If the service does not conform to the contract, you may require us to bring it into conformity and, in the cases provided for by that Act, notify us that you are exercising your right to a price reduction or withdrawal from the contract. Complaints about the payment itself, such as a duplicate charge, may also need to be directed to the Store operator that processed the payment; we will help you with this.

    We handle complaints and reports about other users’ content or conduct in accordance with section 4. We handle personal data requests in accordance with the Privacy Policy.

    11a. Out-of-court dispute resolution

    If you are dissatisfied with how your complaint was handled, you may use out-of-court procedures for resolving complaints and pursuing claims, including:

    • applying to the regional Trade Inspection inspector to initiate an out-of-court consumer dispute resolution procedure;
    • referring the dispute to a permanent arbitration tribunal operating at the regional Trade Inspection inspector’s office;
    • obtaining free assistance from a district or municipal consumer ombudsman or a non-governmental organisation whose statutory activities include consumer protection, such as the Consumer Federation (Federacja Konsumentów).

    Detailed information about out-of-court dispute resolution and a list of authorised bodies are available on the website of the Polish Office of Competition and Consumer Protection (UOKiK): www.uokik.gov.pl. Participation in these procedures is voluntary. If your complaint does not resolve the dispute, our response will state whether we agree or refuse to participate in an out-of-court consumer dispute resolution procedure.

    12. Nature of the service and disclaimers

    GUIDE helps you meet people but does not guarantee that you will meet a partner. AI Content may contain errors. This section does not limit your consumer rights.

    We provide GUIDE with due care and are responsible for ensuring that the service conforms to the contract, as described in section 11. Given the nature of the service, please also note that:

    • we do not guarantee that you will meet a partner through GUIDE, receive a particular number of Suggestions or Matches, or receive replies to your messages. These outcomes also depend on other people’s behaviour and the availability of users who meet your preferences;
    • compatibility scores, explanations and other AI Content are estimates and analyses generated automatically from the information provided. They may be inaccurate or incomplete and do not constitute advice or a prediction that a relationship will succeed;
    • we do not verify the accuracy of information provided by users or check their criminal records or backgrounds (section 5). To the extent permitted by law, we are not responsible for users’ conduct on GUIDE or elsewhere;
    • we use external providers to deliver GUIDE, particularly Store operators, infrastructure providers, an AI feature provider and a verification provider. We are not responsible for interruptions or malfunctions caused exclusively by those providers and beyond our control, subject to our responsibility for the service’s conformity with the contract;
    • you use GUIDE through your own device and internet connection. We are not responsible for problems caused by failure to meet the technical requirements in section 1c or by incorrect device configuration.

    GUIDE is not a medical, psychological or therapeutic service. If you need support in these areas, contact a qualified professional.

    13. Liability

    We are liable to you in accordance with Polish law. We do not limit our liability where the law does not allow it.

    We are liable for failure to perform or improper performance of the contract under the general principles set out in the Polish Civil Code and Consumer Rights Act. Nothing in these Terms excludes or limits our liability for intentionally caused damage, personal injury or any other liability to a consumer that cannot lawfully be limited.

    To the extent permitted by law, we are not liable for loss or damage arising from: (i) acts or omissions of other users or third parties, including content they publish and their conduct on GUIDE or elsewhere; (ii) your breach of these Terms or the law; (iii) your sharing of login details with others; or (iv) force majeure.

    Under general legal principles, you are liable to GUIDE and third parties for damage caused by your breach of these Terms or the law where you are at fault. If a third party brings a claim against us relating to Your Content or your conduct, we will inform you and may ask for your cooperation in investigating the matter.

    14. Intellectual property and infringement reports

    We respect copyright and rights to a person’s likeness. If content on GUIDE infringes your rights, report it to us. We respond promptly.

    The GUIDE name, logo and other branding used on GUIDE are our marks. You must not use them without our prior written consent.

    If you believe that Content available on GUIDE infringes your copyright, rights to your likeness or other rights, send a report to support@guide-dating.com with the subject “Rights infringement”. Your report should include:

    • your full name and contact details;
    • identification of the work, likeness or other right you believe has been infringed;
    • identification of the content that infringes your rights, with enough detail for us to locate it, such as the user’s name and age as shown in the Profile, a description of the photo, and the date and context;
    • an explanation of why you believe the content infringes your rights;
    • a statement that the information in your report is true and that you are acting in good faith, either on your own behalf or with the rights holder’s authorisation.

    We review reports without undue delay. We may remove or restrict access to the reported content and notify the user who published it, giving them an opportunity to respond to the allegations. Repeated infringements of third-party rights will result in Account deletion.

    15. Governing law and dispute resolution

    The contract is governed by Polish law. Disputes are resolved by the ordinary courts. We do not require arbitration or a waiver of the right to bring a court claim.

    The contract concluded under these Terms is governed by Polish law. This choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of habitual residence where those provisions are more favourable to you.

    Disputes arising out of or relating to the contract are resolved by the ordinary courts with jurisdiction under the general rules, particularly the Polish Code of Civil Procedure and, where applicable, European Union rules on jurisdiction in consumer matters. We do not require mandatory arbitration or a waiver of the right to bring a court claim or participate in collective proceedings.

    Before bringing a court claim, we encourage you to contact us. Most issues can be resolved through the complaints procedure (section 11). You may also use the out-of-court dispute resolution procedures described in section 11a.

    16. General provisions

    These Terms, together with the Privacy Policy and the purchase terms displayed in the App, set out our entire agreement. Your Account is personal and non-transferable.

    These Terms, together with the Privacy Policy and the terms of the particular offer displayed in the App before purchase, constitute the entire agreement between you and GUIDE concerning your use of GUIDE and replace all previous arrangements on that subject.

    If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in force. The relevant legal provisions apply in place of an invalid provision.

    Your Account is personal. You may not transfer your Account or your rights under the contract to another person. Rights to the Account and the Content stored in it end on the user’s death, unless the law provides otherwise.

    We may transfer our rights and obligations under the contract to another entity, particularly in connection with a corporate conversion, merger or sale of all or part of our business, provided this does not adversely affect your rights. We will notify you in advance. If you do not agree to the transfer, you may terminate the contract free of charge.

    Our failure to exercise any right under these Terms does not constitute a waiver of that right.

    These Terms were drawn up in Polish. If we provide translations, the Polish version prevails in the event of any discrepancy, to the extent permitted by law. The language of the contract and our communications is Polish; we may also provide support in English.

    The headings and section summaries are provided for convenience and ease of reading, but do not affect the interpretation of these Terms. Masculine forms used in the Polish version refer to all users, regardless of gender.

    Matters not covered by these Terms are governed by Polish law, particularly the Civil Code, the Consumer Rights Act, the Act on the Provision of Services by Electronic Means and the Act on Copyright and Related Rights.
